Tax Considerations

Form 1099-DA is new for the 2025 tax year. Brokers issued first 1099-DAs in February 2026 reporting gross proceeds only. Cost basis reporting becomes mandatory for the 2026 tax year (forms issued 2027) on assets acquired January 2026 or later at the same broker.

Wash sale rules do not currently apply to directly held crypto. Because crypto is classified as property rather than securities, IRC §1091 does not apply. Clients can sell at a loss and immediately repurchase. This is a legitimate tax-loss harvesting tool that may not survive — bipartisan proposals to extend wash sale rules to digital assets are active in Congress.

Spot crypto ETFs are treated as securities for tax purposes. Wash sale rules DO apply to ETF shares. Advisors should distinguish between direct crypto holdings and ETF exposure when modeling client tax scenarios.

Red Flag Reference

Keep this section bookmarked. When a client brings up a crypto "opportunity," run through these before anything else.

🚨 Language Red Flags

  • 🔴 "Guaranteed returns" — no legitimate investment guarantees anything
  • 🔴 "Risk-free" — crypto is inherently volatile; this is a lie
  • 🔴 "Limited time offer" — pressure tactics; legitimate opportunities don't expire in 24 hours
  • 🔴 "Double your money" — classic scam promise
  • 🔴 "Only insiders know about this" — if it were real, they wouldn't be telling strangers
  • 🔴 "This is the next Bitcoin" — almost all alternative tokens fail
  • 🔴 "Celebrity X endorsed this" — fake endorsements are rampant; verify independently

⚠️ Channel Red Flags

  • 🔴 Unsolicited DM via Telegram, WhatsApp, or Discord — scammers' preferred method
  • 🔴 Social media comment or reply — impersonation is trivial on these platforms
  • 🔴 Dating app match — the "pig butchering" romance scam vector
  • 🔴 A "friend" the client has never met in person
  • 🔴 Unsolicited email with investment opportunity
  • 🟡 YouTube/TikTok influencer — many are paid promoters, not advisors

🎭 What Scammers Say About Advisors

  • 💬 "What are their credentials?"
  • 💬 "They know old money — what do they know about new money?"
  • 💬 "They just want fees; that's why they don't care about crypto."
  • 💬 "Are they protecting you or preventing you?"
  • 💬 "Do they even have Telegram?"

These lines are designed to isolate clients from trusted advisors. Your literacy is your best counter-argument.

🕵️ Common Scam Types

  • 💔 Pig Butchering: Fake romance → trust-building → "investment" → funds drained over time
  • 🏦 Fake Exchange: Convincing website, shows fake gains, blocks withdrawals
  • 🎭 Impersonation: Pretends to be Coinbase support, a celebrity, or a known project
  • 🏃 Rug Pull: Legitimate-looking project, team disappears with funds
  • 📧 Phishing: Fake emails or sites that capture login credentials
  • 📈 Pump & Dump: Hype a worthless token, sell high, leave buyers holding nothing
Quick Client Checklist — Run Through This Before Any Crypto Decision
Did someone approach you, or did you find them?
Are you being asked to act quickly?
Were you asked to move funds to a new wallet or exchange?
Are returns described as "guaranteed" or "risk-free"?
Is the communication happening on Telegram, WhatsApp, or Discord?
Did a romantic interest introduce you to this opportunity?
Are you being asked to keep this secret from family or your advisor?

2+ "Yes" answers = HIGH probability of scam. Pause and investigate.
